Please read Section 8 carefully. It affects your legal rights.
1. About This Disclaimer
1.1 This Health and Wellness Disclaimer (the "Disclaimer") explains what the Plan To Win app, the Map of You quiz, website, emails, social features and coaching (the "Service") are and are not, and the risks of using them. It is one of the four Legal Documents you accept before you start using the app or the Map of You, and it forms part of our Terms of Service. "We", "us" and "PTW" mean Zackery Frank Boyle, carrying on business as Plan To Win. "You" means the person using the Service.
1.2 What the Service is. Plan To Win helps you plan your days across six areas of life: Fitness, Diet, Finances, Relations, Personal and Work, and the Map of You gives you a values reading that feeds into that plan. It offers plans, logging, reminders, an optional wake-up alarm, reflection tools, tools for habits you want to quit, and an AI coach. The Service is for general information and planning.
1.3 What it is not. It is not:
- a medical service, or a doctor, nurse, dietitian, physiotherapist or personal trainer who has examined you;
- therapy, counselling, mental-health or addiction treatment;
- a crisis or emergency service, and we do not monitor your use in real time;
- a diagnosis or a treatment plan of any kind.
2. No Medical Advice
2.1 Nothing in the app, the Map of You, our website, our emails, our social posts, our social features or coaching is medical advice. Do not ignore professional medical advice, or delay getting it, because of something you read or were told through Plan To Win.
2.2 Workouts, meal ideas, calorie and macro numbers, supplement amounts, and sleep and stress suggestions are general. They are made for a typical person, and they do not know your full medical history. They may be wrong for you.
2.3 We do not claim that the Service will prevent, treat or cure any condition, and we do not promise any health result.
3. See a Professional First
Talk to a physician or other qualified health professional before you begin or change any exercise, diet, fasting, weight, sleep or stress programme, before you stop or cut down a substance you depend on, and especially if you:
- have or have had a heart, blood-pressure, breathing, metabolic (such as diabetes), bone or joint, or neurological condition;
- are pregnant, trying to become pregnant, or postpartum;
- are recovering from an injury, illness, surgery, an eating disorder or a dependence;
- take any medication or supplements;
- are over 65, or have not been active for a long time;
- have any doubt at all about whether an activity is safe for you.
The Service is for adults, 18 and over.
4. Emergencies and If You Are in Danger
4.1 Emergency instruction. If you are in immediate danger, or someone else is, contact your local emergency number now (for example 911 in Canada and the US, 112 in the EU, 999 in the UK). The app cannot do this for you.
4.2 Stop right away and get medical help if you feel pain, dizziness, faintness, nausea, chest pain or pressure, trouble breathing, an irregular heartbeat, or anything that just feels wrong. Do not push through it because a plan or an app said so. Rest, or make an activity easier, whenever you need to. The plans are there to serve you.
4.3 Support. To find a free, confidential crisis line in your country, visit findahelpline.com. You can also reach out to a trusted friend or family member today. The app may show you these resources if what you write sounds heavy. That is a kindness, not a diagnosis.
4.4 Safety notification. See Section 11.
4.5 Event mode. Event mode is not an emergency, medical, security or monitoring service (Terms, Section 13.6). Its reminders about water, food, rest, charging your phone, meeting up or getting home safely are general information, and Plan To Win gives no advice about alcohol, drugs or any other substance. If you or someone with you feels unwell, stop, get somewhere safe, tell someone near you, and call your local emergency number.
5. Your Health Information, LifeScore and Other Numbers
5.1 LifeScore. LifeScore is a motivational estimate of how your habits are building a healthier, fuller life, compared with your own past. It is not a medical assessment, a health measurement, a diagnosis, a risk score, or a prediction of your lifespan or health. It is based on the information you enter and connect, which may be incomplete or wrong.
5.2 XP, levels, streaks, badges, phases and day counters reward effort. They are not health measures. The overall level is a display scale we may adjust.
5.3 Your Map of You reading. Your archetype, values, edge and other reading content are motivational and reflective, generated by an AI from the answers you give. They are not a personality diagnosis, a psychological assessment, or a prediction about your life.
5.4 Phone and device data. Numbers from your phone's health app (steps, sleep, heart rate, active calories and weight, if you connect them) and the distance and pace of a cardio session worked out from your phone's location come from your device and its sensors, which can be inaccurate or incomplete (for example, your phone's health app may count steps differently from Plan To Win). Do not use them to make medical decisions.
5.5 Food, calorie and supplement estimates. Estimates from photos, descriptions, barcode lookups or the AI, and supplement amounts you enter or pick from typical label values, are approximate and can be wrong. Do not rely on them for a medical diet, an allergy, a dietary restriction, or a dosing decision.
5.6 Cycle and period tracking (planned). We plan to offer optional cycle and period tracking. It is not in the app today. When it launches it will be opt-in, with its own separate consent, and it will not be a contraception method, a fertility or pregnancy test, or medical advice.
5.7 Habits you are quitting. If you set an anti-goal (for example quitting smoking, vaping or drinking), the counter, milestones and slip log are there to encourage you, never to judge you. They are not addiction treatment or medical advice. Stopping some substances suddenly can be dangerous. If you drink heavily, use a substance daily, or take medication that should not be stopped abruptly, talk to a doctor before you stop or cut down, and get help right away if you feel unwell after stopping.
6. Fitness, Diet and Body Image
6.1 Fitness. Start where you are, build up gradually, use safe form and equipment, and get instruction if you need it. Exercise carries risks (Section 8). Animated exercise demonstrations show a general movement, not a form check of you.
6.2 Diet and weight. Plan To Win aims for health, capability and sustainability, never for appearance or restriction. Food logging, calorie and macro numbers and weight tracking are optional tools. If tracking food or weight makes you anxious or obsessive, or is tied to an eating disorder or a history of one, please stop using those tools and talk to a professional. Do not use the app to follow an extreme or restrictive diet without medical guidance.
6.3 Allergies. If you have a food allergy or intolerance, check ingredients yourself.
7. Mental Wellbeing, Reflection and Not Therapy
7.1 The reflection, values, identity, journaling and mood check-in features, and the Map of You quiz, are for understanding yourself better: a mirror you help shape. They are not therapy, not counselling and not treatment for any mental-health condition. The AI is not a therapist.
7.2 If something feels too big to carry, please reach out to a person you trust or a qualified professional. Plan To Win cannot monitor you in real time and cannot promise anyone will see or respond to what you write.
7.3 Social features. Encouragement from people you link with is between you and them. We do not monitor it, and a cheer, a challenge or a pact is not advice.
7.4 Looking back with the coach. If you allow the coach to look back at your journal, mood check-ins and activity, it is to help you notice your own patterns, not to assess your mental health. It does not diagnose, and what it says is not medical advice or therapy. If something it reads or you read back feels heavy, please talk to a person you trust or a qualified professional.
8. Assumption of Risk and Release
Please read this Section carefully. It affects your legal rights.
8.1 The risks. Exercise, changes to diet, fasting, and other activities suggested by the app, the AI or a coach carry risks, including muscle, joint and bone injury, cardiovascular events, dehydration, falls, overexertion, allergic reactions, eating-related harm, the worsening of medical conditions, and, in rare cases, serious injury or death. Changes to sleep, stress or routine, and stopping a habit or substance, can also affect how you feel.
8.2 What you confirm. By using the Service, you confirm and agree that:
- you have read this Disclaimer and understand the risks;
- you choose to take part voluntarily and you accept those risks;
- you are physically and mentally able to take part in the activities you choose, or you have been cleared by a qualified professional;
- you are solely responsible for your decisions and actions, including how you use any plan, suggestion or AI output ("your final call"), and for getting medical advice for anything medical.
8.3 Release. To the fullest extent permitted by law, you release and hold harmless Zackery Frank Boyle, carrying on business as Plan To Win, and its owners, employees, contractors, coaches and service providers (the "Released Parties") from any claim, loss, injury, illness or damage (including personal injury, property damage or economic loss) arising from your use of the Service, or from following, or not following, any content, plan, AI output or advice in it or in coaching, except where the law does not allow such a release.
8.4 Where the release does not apply. This release does not apply where the law forbids it. In particular, it does not release liability for our fraud or wilful misconduct, and, where the law does not allow it to be released, our gross negligence, our negligence causing death or personal injury, or breach of a right that cannot be waived under consumer-protection law. Whether a release is enforceable varies widely by country, province and state, and may not be enforceable for minors. If any part is unenforceable where you live, the rest still stands and you keep the rights the law gives you.
9. AI and Coaching
AI output can be wrong. Coaching is coaching, not treatment. Neither replaces a professional. See the AI and Coaching Disclosure.
10. Other Areas of Life
The Finances, Relations, Personal and Work areas are for planning and reflection. They are not financial, tax, legal, investment or relationship-counselling advice. Speak to a qualified professional before major decisions. We do not recommend particular investments, and nothing in the Service is a recommendation to buy or sell anything. Where a tool opens an outside website or AI assistant for you, what you find there is that site's content, not ours.
11. Serious-Safety Notification
If our systems detect signs you may be in serious danger, we may notify the PTW team so someone can reach out. The notice contains your account and the time only, and not what you wrote. We cannot monitor in real time, we do not promise to see the notice quickly, or at all, and we are not an emergency service. See the AI and Coaching Disclosure (Section 8).
12. Age
The Service is for people aged 18 and over. If you are under that age, do not use the Service.
13. Changes and Contact
We may update this Disclaimer, and we will ask you to accept again if the change is material (Terms, Section 3). Questions: hello@plantowin.app.
